We at Aware AI Technologies Private Limited (together with our affiliates hereinafter referred to as “TheAware.AI”, “company”, “we”, “our” or “us”) values the trust of our users who uses the tools of our product for personal development and to store personal data (hereinafter referred to as “you”) and is committed to protect it in all respects. The company is aware that it will be dealing with personal and/ or sensitive personal information. This privacy policy (“Privacy Policy”) sets out how the company collects, uses, retains, discloses, shares, and safeguards your information/ data. When you register yourself to access the mobile application designed for our product Mirror, deployed on Android and iOS platforms ("Mobile App") dedicated to individual's personal growth and overall emotional well-being (hereinafter referred to as “Services”), you confirm that you understand, agree and consent to be bound by the terms and conditions of this Privacy Policy.

This Privacy Policy is applicable to all Mobile App users, including clients seeking access to the therapeutic services provided by the licensed mental health professionals, such as therapists, counsellors, and coaches.

Personal information

We collect information relating to you that identifies you and the following information forms part of personal information (“Personal Information”):

  1. Account Information:When you create an account with us, we will collect information associated with your account, including email ID, Google account or Apple ID credentials. You will be prompted to set up a secure profile, including optional personal details like name, phone number, date of birth, gender, and location. Once you provide this information, we will use them to personalise your experience on the Mobile App. (“Account Information”).
  2. Billing and Payment Integration: A secure billing and payment system is integrated into the platform, enabling you to manage payments for both subscriptions and professional sessions seamlessly. You can securely store your payment details within the Mobile App (“Payment Details“), which will be encrypted and tokenized for enhanced security. The payment processing is to be handled by a trusted third-party payment gateway, adhering to industry-standard security protocols and regulations. You will have the ability to view your billing history, manage subscriptions, and update their payment information as needed within the Mobile App's secure payment interface.
  3. Other Information: We collect other information that you may provide to us, such as when you choose to post messages on our message boards, blogs or other message areas or leave feedback; when you participate in our events or surveys or provide us with information to establish your identity and when you send us personal correspondence, such as emails or letters, or third parties send us correspondence about your activities or postings on the Mobile App (collectively referred to as “Other Information”).

Personal Information includes sensitive personal data and shall be securely stored on the servers of the company, ensuring privacy and confidentiality. Personal Information is used to interact for authentication and is never sold to a third party.

Application Data

The following information includes data that you create and interact within the Mobile App (“Application Data“), but which does not form part of Personal Information:

  1. Journaling:You can create journal entries on your device (“Journal“). You have the option to enable automatic backups, which will seamlessly sync your journal data to your personal google drive (for Android users) or iCloud (for iOS users). This backup feature is optional and fully under your control. You can create journaling templates with prompt (“templates“). You can also set reminders to use these templates for journaling at a desired frequency. At no point we or any third party will gain any access to the content of your Journal or Templates, as we prioritize maintaining the utmost confidentiality of your writings and reflections. You can share entries from your Journal with your licensed mental health professional to provide context and facilitate the therapeutic process. Even if shared, only your licensed mental health professional or you can review the shared entries from your Journal, providing valuable context and insights into your thoughts, emotions, and experiences.
  2. AI Prompts and AI Chatbot: We generate AI prompts by calling APIs hosted on the servers or the user's local device to help you with journaling. You can chat with an AI chatbot to get more clarity about your thoughts and emotions. With respect to AI prompts and AI chatbot, no chats are stored in the server of the company or used to train AI models. AI chatbot only contextualizes its responses by referencing previous conversations of the user, within the Mobile App.

Please Note: The AI chatbot will only be used to help regulate emotions or help you gain deeper insights. It will not be used as a replacement for licensed mental health professionals or traditional therapeutic processes.

  • Appointment Management: You can schedule appointments with your licensed mental health professional through the Mobile App's integrated calendar system. You can book the available time slots of licensed mental health professionals ("Appointments"). Appointments are stored on the servers of the company, for sending reminders to both the parties.
  • Communications: You can connect with licensed mental health professionals, including therapists, counsellors, and coaches, through the Mobile App. The Mobile App allows you to securely communicate with your licensed professional through chat, text, audio, or video sessions ( "Communications"). These Communications can be divided into two parts:
    • During-session data: YWith respect to the data transmitted during the session, for example, video calls and chats while on call, the company does not record or store them.
    • In-between-session data: With respect to the data transmitted when not in session, for example, chats and texts outside the session or between two sessions, the company stores them in its server. These in-between-session types of Communications are encrypted and stored securely, maintaining the confidentiality of the therapeutic relationship.

Your Journal, Templates, and AI interactions are stored locally on your device. Appointments, shared journal entries with your licensed mental health professional, and in-between-session Communications are securely stored in encrypted form in our servers and accessible only to you and your licensed mental health professional. No during-session Communications is ever recorded or stored on our servers. No data is sold to third parties.

Technical Information

When you visit, use, or interact with the Services, we receive the following information about your visit, use, or interactions (“Technical Information ”):

  • Device and Browser Information: Includes device identifiers, name, and type, operating system, browser type and version, and internet protocol (IP) address. We collect this information automatically when your device interacts with our Services.
  • Usage Data: We may automatically collect information about your use of the Services, such as the types of content that you view or engage with, the features you use and the actions you take, as well as your geographic location (time zone, country), the dates and times of access. This information helps us understand popular features, optimize content, and improve the overall user experience.
  • Cookies: We use data collection devices such as ‘cookies’ on certain pages of the Mobile App to help analyse our web page flow, measure promotional effectiveness, understand your preferences, and promote trust and safety. ‘Cookies’ are small files placed on your hard drive that assist us in providing our Services. We may offer certain features that may be only available using a ‘cookie.’ We also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Most cookies are ‘session cookies,’ meaning that they are automatically deleted from your hard drive at the end of a session. You may choose to disable or reject the cookies altogether, although in that case you may not be able to use certain features on the Mobile App and you may be required to re-enter your password more frequently during a session. Additionally, you may encounter ‘cookies’, or other similar devices on certain pages of the Mobile App that are placed by third parties. We do not control the use of cookies by third parties.

    The Technical Information is used to monitor and maintain performance, enhance security, debug issues that may arise, and improve the overall quality and functionality of the Services. Analyzing this data helps us optimize your user experience and ensure our Services meet your needs.

Use of Personal Information

We may use Personal Information for the following purposes:

  1. To provide, administer, maintain and/or analyze the Services;
  2. To improve our Services and conduct research;
  3. To communicate with you; including to send you information with regards to our Services and events;
  4. To develop new programs and services;
  5. To prevent fraud, criminal activity, or misuses of our Services, and to protect the security of our IT systems, architecture, and networks;
  6. To provide customer support, troubleshoot problems, and respond to product and service requests made by you, as permitted by applicable law; and
  7. To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.

Disclosure of personal information

  1. Legal Requirements: We may disclose your Personal Information, only if required to do so, by law or in the good faith belief that such action is necessary to comply with applicable laws, or any legal obligation, or governmental requests. We may also disclose your Personal Information to establish or exercise our legal rights; to defend against any legal claims/liabilities; or as otherwise required to protect safety, security and integrity of TheAware.AI, its affiliates, users, employees and the general public at large.
  2. Affiliates: We may disclose Personal Information to our affiliates, meaning an entity that controls, is controlled by, or is under common control with TheAware.AI. Our affiliates may use the Personal Information we share in a manner consistent with this Privacy Policy.

While sharing your Personal Information with third parties, as described above, we will ensure that such third parties are subject to this Privacy Policy and/ or follow practices at least as protective as those described under this Privacy Policy.

Your rights

You have certain statutory rights in relation to their Personal Information. For example, you may have the right to:

  1. Access your Personal Information and information relating to how it is processed.
  2. Delete your Personal Information from our records.
  3. Rectify or update your Personal Information.
  4. Transfer your Personal Information to a third party (right to data portability).
  5. Restrict how we process your Personal Information.
  6. Withdraw your consent—where we rely on consent as the legal basis for processing at any time.
  7. Object to how we process your Personal Information.
  8. Lodge a complaint with your local data protection authority.

You can exercise these rights through your TheAware.AI account. If you are unable to exercise your rights through your account, please submit your request by sending an email to mirror@theaware.ai.

Children

Our Services are not directed to children under the age of 13. TheAware.AI does not knowingly collect Personal Information from children under the age of 13. If you have reason to believe that a child under the age of 13 has provided Personal Information to TheAware.AI through the Services, please email us at mirror@theaware.ai. We will investigate any notification and if appropriate, delete the Personal Information from our systems. If you are 13 or older, but under 18, you must have permission from your parent or guardian to use our Services.

Security and retention

We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error free. In particular, email sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Services or email. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Services, or Third-Party Pages.

We’ll retain your Personal Information for only as long as we need in order to provide our Services to you, or for other legitimate business purposes such as resolving disputes, safety and security reasons, or complying with our legal obligations. How long we retain Personal Information will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements.

Unsubscribe

The company provides you with the opportunity to opt – out of receiving non-essential (promotional, marketing-related) communications from the company on behalf of our partners, and from the company in general, after setting up an account.
